Salvi, Schostok & Pritchard obtains $6.625 million wrongful death settlement

Salvi, Schostok & Pritchard P.C. attorneys Thomas R. Mulroy III, Aaron D. Boeder and Michael J. Schostok recently obtained a $6,625,000 settlement on behalf of the family of a 52-year-old woman who died as a result of complications during her colonoscopy prep.

Plaintiff had a history of GI problems and was scheduled for a colonoscopy on December 8, 2017. However, she was unable to complete the liquid prep due to pain and discomfort. With increasing pain, Plaintiff’s gastroenterologist canceled the procedure and advised her to go to the hospital.

At 5 p.m. that evening, a CT scan was ordered at the hospital to rule out a bowel obstruction. The images on the CT scan demonstrated that a bowel obstruction was present in the large intestine/colon, but the CT report issued by the Defendant radiologist was ambiguous and did not clearly notify the clinicians that the fecal impaction visualized on the scan was in fact a type of bowel obstruction.

About 3 hours later, the Plaintiff was sent to the medical floor with increasing pain. Upon arrival, tests showed her vital signs were highly abnormal. However, hypothermia documented in her chart was allegedly an “error” per her nurses and claimed to be found normal on recheck. Plaintiff’s attorneys alleged her nurses did not notify doctors of her severe pain or abnormal vitals.

Around 3 a.m., Plaintiff was found unresponsive. Her cause of death was determined to be from medical malpractice and was caused by a bowel perforation due to the obstruction.

Plaintiff is survived by her husband and one son.
