PEORIA, Ill. (September 16, 2021) – Salvi, Schostok & Pritchard P.C. attorneys Matthew L. Williams and Aaron D. Boeder have obtained a $2 million settlement on behalf of a woman who suffered a permanent colostomy due to the delayed removal of a cancerous tumor.
On September 9, 2013, 48-year-old Plaintiff underwent a colonoscopy in which her physician found five polyps. During the procedure, the doctor was able to fully remove three of the five polyps and partially remove two of the polyps. Test results showed the two partially removed polyps were cancerous. Plaintiff’s doctor referred her to Dr. Julius Bonello at the Peoria Surgical Group for removal of the two cancerous tumors.
On September 26, 2013, Dr. Bonello performed surgery on Plaintiff to remove the tumors. Following the procedure, Plaintiff was advised that the cancerous tumors were fully removed from her colon.
In the fall of 2014, it was learned that one of the cancerous tumors was in fact not removed during the September 26 procedure. Plaintiff then underwent a third procedure to remove the cancerous tumor.
Plaintiff’s attorneys allege the delayed removal of the cancerous tumor allowed the cancer to further spread and led to Plaintiff suffering a permanent colostomy.
“Although our client is cancer free, the failure by Dr. Bonello to remove the cancer during the first surgery caused the tumor to grow and damage adjacent organs such that a permanent colostomy was necessary to ensure the cancer was completely removed. Although she was fortunate the cancer was still curable when the tumor was removed, she suffers on a daily basis due to her colostomy. This was clearly an avoidable outcome.” Plaintiff’s attorney Matthew L. Williams said.
On September 13, 2021, the parties entered into a settlement agreement of $2 million, insurance policy limits of the Peoria Surgical Group and Dr. Bonello.
