$1.4 million settlement for man injured in Niles motorcycle accident

NILES, Ill. (September 16, 2021) – Salvi, Schostok & Pritchard attorney Brian L. Salvi obtained a $1.4 million settlement on behalf of a motorcyclist who was seriously injured in a Niles, Ill. crash.

On July 28, 2018, 57-year-old Plaintiff was driving his 2013 Can-Am Spyder, a 3-wheeled motorcycle, southbound on Caldwell Avenue near the intersection of Wood River Drive in Niles. At the same time Defendant Brian Rosenblatt pulled out of his apartment building’s parking lot. As Mr. Rosenblatt attempted to make a left turn onto Caldwell, he struck Plaintiff’s vehicle, throwing him from the motorcycle and onto the pavement at approximately 25-30 mph.

As a result of the crash, Plaintiff suffered an AC joint separation in his left shoulder, a left elbow fracture and left foot fracture. Plaintiff underwent surgery on his elbow, but continues to have residual pain.

Attorneys for Mr. Rosenblatt argued the Plaintiff was contributorily negligent and disputed the extent of his pain complaints based on him returning to work as a mechanical assembler 3 months after the collision.

On September 14, 2021, the parties entered into a settlement agreement in which Mr. Rosenblatt’s insurance would pay Plaintiff $1.4 million to compensate him for his injuries and wage loss.
