CHICAGO (November 1, 2022) – Salvi, Schostok & Pritchard attorneys Rob L. Kohen, Thomas R. Mulroy III and Heidi L. Wickstrom recently obtained a $1,750,000 settlement on behalf of a woman who was injured in an Indiana car crash while traveling on business.
On December 22, 2014, Plaintiff, 37, was a passenger in a vehicle owned by her boss and employer and operated by a fellow male co-worker. The Plaintiff and her male co-worker were traveling back to the Chicago area from a business trip in Indiana. As the vehicle was traveling northbound on I-65 near mile marker 189 in White County, the male driver lost control of the vehicle, causing a significant rollover collision with another vehicle. The male driver was pronounced dead at the scene.
As a result of the crash, the Plaintiff suffered trigeminal and occipital neuralgia that may require surgical and non-surgical treatment for the rest of her life.
In 2018, Plaintiff filed a lawsuit against the company and individual who owned the vehicle and the driver’s estate, claiming the company was negligent in their control of the vehicle and that their employee negligently operated the vehicle, causing Plaintiff’s injuries. The auto policy for the vehicle was limited to $250,000. The defendants asserted the dead man’s act and disputed liability, agency, causation and damages.
On October 6, 2022 – the same day a jury trial was set to begin in Cook County Circuit Court – the parties agreed to settle the case for $1.75 million.
