Salvi, Schostok & Pritchard obtains $1.44 million settlement for family of woman who died during childbirth at suburban hospital

CHICAGO (March 24, 2022) – Salvi, Schostok & Pritchard attorneys Aaron D. Boeder, Lance D. Northcutt and Heidi L. Wickstrom recently obtained a $1.44 million settlement for the family of a woman who died while delivering the couple’s first child at a suburban Chicago hospital.

On, December 22, 2014, 40-year-old Plaintiff and her husband arrived at a suburban hospital around 5 a.m. to give birth to their first child.  Plaintiff was in labor for more than 12 hours.

That evening, Plaintiff began to feel pain and discomfort, vomited, and had a low fever. During this tumultuous labor, Plaintiff’s doctor was not at the hospital and it was only after numerous calls from nurses did her doctor physically come to the hospital to check on the situation.

By the time he arrived, Plaintiff’s condition had worsened and she tragically died at the hospital of Amniotic Fluid Embolism (AFE) on December 23, 2014. The woman’s baby was born in a severely depressed condition but was able to make a full recovery after body cooling.

The family of the decedent filed a lawsuit in 2016 alleging an earlier delivery and anesthesia treatment would have greatly increased the likelihood of her survival and avoided injury to baby.

A trial was set to begin in Cook County Circuit Court before the Honorable Marguerite A. Quinn March 21, 2022 and the case settled during a pretrial with Judge Quinn just prior to jury selection.

“Nothing will replace our client’s loved one or take away the pain of a husband losing his wife while she gave birth to their only child, but this verdict provides the family with the necessary means to ease their financial burdens as they deal with this immense loss,” Plaintiff’s attorney Aaron D. Boeder said.
