$1.6 Million Settlement Reached in Will County, Infant Dies at Saint Joseph Medical Center

CHICAGO, IL  - Michael P. Schostok of Salvi, Schostok & Pritchard, P.C. announced a $1.6 million medical malpractice settlement was reached in Will County (Illinois) on behalf of the family of an infant who tragically died when his medical care providers failed to properly manage his intra-abdominal illness. Judge Gerald Kinney of the 12th Judicial Circuit Court of Will  County approved the settlement.  The settlement was believed to be one of the largest known of its kind in Will county.  [SHEQUETTA WILSON, Special Administrator of the Estate of NOAH WILSON, deceases v. According to Attorney Michael Schostok, on September 25, 2002, the minor decedent, Noah Wilson was admitted with abdominal pain and dehydration to Saint Josephs Medical Center in Joliet, Illinois.  Throughout the evening, Noah’s condition became increasingly worse due to abdomen swelling.  Despite increased pain, abdominal swelling, and abnormal lab studies, Dr. Niazi stood by and waited – neglecting to act on behalf of his patient, Noah Wilson.  By 4:00 a.m. on September 26, the five-month-old Noah Wilson lapsed into septic shock and died on the way to the operating room.  An autopsy later determined that Noah died from untreated constipation.

“Noah’s death was easily preventable and only occurred because Dr. Niazi and the nurses caring for Noah failed to adequately communicate with one another,” said Attorney Michael Schostok.  “As Noah’s condition deteriorated, certain nurses assumed Dr. Niazi knew of Noah’s rapidly developing abdominal catastrophe.  Dr. Niazi claimed he wasn’t informed of Noah’s worsening symptoms, but the medical records and his own testimony clearly showed that Dr. Niazi ignored Noah’s condition and abandoned the infant in his moment of need.”
